Question Alternatively, in the event that the County will not waive the bond requirements, we ask that the County consider the following:
The RFP states that bonds, if required, will be due for 100% of the contract amount. As this is a standby contract, without a pre-determined contract amount, to be activated upon need by the County for a specific project, can the County please confirm that if bonds are required that they will be due upon activation of the Contract once a cost estimate has been prepared by the Contractor for the specific project?
Answer This is part of the standard terms and conditions of every solicitation and states that they MAY be required. Bonds are not required as part of the initial award.

Question Regarding Bonding question:
a. A bid guarantee from each bidder equivalent to five (5%) percent of the bid price. The ‘‘bid guarantee’’ must consist of a firm commitment such as a bid bond, certified check, or other negotiable instrument accompanying a bid as assurance that the bidder will, upon acceptance of the bid, execute such contractual documents as may be required within the time specified.
b. A performance bond on the part of the contractor for 100 percent of the contract price. A ‘‘performance bond’’ is one executed in connection with a contract to secure fulfillment of all the contractor’s obligations under such contract.
c. A payment bond on the part of the contractor for 100 percent of the contract price. A ‘‘payment bond’’ is one executed in connection with a contract to assure payment as required by law of all persons supplying labor and material in the execution of the work provided for in the contract.

Question We are kindly requesting that the Coun waives all of the Bonding requirements as the Federal procurement regulations in 2 CFR §200.325 only recommends bonding requirements for construction or facility improvements contracts. 2 CFR 200.325 states the following:
§ 200.325 Bonding requirements. For construction or facility improvement contracts or subcontracts exceeding the Simplified Acquisition Threshold, the Federal awarding agency or pass-through entity may accept the bonding policy and requirements of the non-Federal entity provided that the Federal awarding agency or passthrough entity has made a determination that the Federal interest is adequately protected. If such a determination has not been made, the minimum requirements must be as follows:

Question Per Section 7.22 of the RFP, the Contractor must be compliant with the HIPAA and HITECH Act and the Contractor may be required to enter into a Business Associate Contract with the County.
a. As the primary services under this RFP are for disaster debris monitoring services, and these services typically do not fall under the purview of the HIPAA or the HITECH Act, can the County please confirm that Section 7.22 will not apply in the event the resulting contract is activated for disaster debris monitoring services?
b. Further, can the County confirm that Section 7.22 will only apply when the resulting contract is activated for services that involve the transmission, acquisition, storage, or the like of data/information governed by the HIPAA or HITECH Act?

Question Attachment A - Federal Terms and Conditions - Would the county be agreeable to remove the reference to the Coronavirus State & Local Fiscal Recovery Funds And American Rescue Plan Act of 2021 (SLFRF) as it is not applicable and not eligible to be utilized for storm related issues.

Would the County be agreeable that in accordance with FEMA requirements that only the 2 CFR 200 Appendix II be applicable to the contract?
Answer No. Attachment A is standard Federal Terms and Conditions. All clauses that would be applicable to this contract would be required.

Question As an Automated Debris Management System has become the industry standard for debris monitoring, should ADMS pricing be included in all position rates that will require the use of an ADMS? Should a Proposer choose to propose rates with an ADMS fee separately, should that Proposer specify exactly which positions would be charged that additional ADMS fee and include that additional fee in the total costs (hourly or lump sum) so that the COUNTY can accurately assess the overall cost of the proposal?
Answer Cost is not required and should not be submitted with the proposal per Item No. 11.6 on Page 21 of the RFP document.
