Request for Proposal 2023-005Lease of Property for Fireworks StandCity of Derby, Kansas


The City of Derby will accept proposals until 5:00 p.m. on Thursday, February 9, 2023, for lease of property owned by the City of Derby to be used for operation of a fireworks stand during the 2023 season, with the option to renew for the 2024 and 2025 seasons if available. Subsequent to the 2023 season the properties may be part of a road project and therefore unavailable for use as a fireworks stand. The properties are located at 407 W. Patriot in Derby (just west of the city’s water metering station) and 2212/2230 N. Nelson Drive (east side of Highway K-15 on frontage road). Buildings that were on the Nelson Drive site have been demolished so all properties are vacant land with no access to electricity. The properties will be leased for a term beginning June 17, 2023 and end at midnight, July 8, 2023. Note: Sale of fireworks is permitted within the City of Derby only from June 27th through July 5th.

A sample lease agreement attached to this RFP sets forth the terms of the lease the City expects to execute with the successful respondent. This sample lease will be supplemented by inclusion of provisions pertaining to any benefits to the community included in the successful respondent’s proposal. In addition, respondents must provide the information required on the attached proposal form.

In selecting a lessee, the overall benefit to the community will be considered. Rent for lease of the property is in addition to the $8,000 fee required to obtain a permit for sale of fireworks. A deposit equal to the rental offered for the property must accompany respondent’s proposal. The deposit of the successful respondent will be retained by the City as rental for the property. Deposits of other respondents will be refunded promptly upon execution of a lease agreement for the property. The City of Derby reserves the right to reject any and all proposals with or without cause, to accept any proposal, and to waive irregularities in any proposal.
