This document is a Request for Proposals. It differs from a Request for Bids/Quotations in that the City is inviting proposals for professional services that are most advantageous to Derby, in Derby’s sole discretion for a Total Compensation Study. This is not a bid/quotation meeting firm specifications for the lowest price, and as such, the lowest price proposed will not guarantee an award recommendation. Competitive Proposals will be evaluated based upon criteria formulated around the most important features of the service, of which quality, references, availability or capability, may be overriding factors.

It is the sole responsibility of the candidate to see that its response and the appropriate documents are delivered on time. Any response received after the scheduled closing time for receiving proposals will not be considered. Interested candidates are responsible for checking Derby’s website and acknowledging all addenda in their response.

Proposed pricing for services may be disclosed at a public meeting. Refer to the Confidential Matters section below for additional information on what information may be subject to disclosure, due to the Kansas Open Records Act.

DESCRIPTION OF PROJECT AND NATURE OF RFP

Project: The City of Derby, Kansas, hereinafter referred to as the “City”, is seeking proposals from qualified Consultants/Firms to conduct a total compensation study, as outlined in the scope of work. The selected consultant will also be responsible for reviewing and providing recommendations on all pay related policies and procedures. The tangible deliverables expected include, but are not limited to the following:

  • Pay plans for positions that support internal equity and maintain external competitiveness;
  • Recommended applicable policies, procedures and guidelines for ongoing effective salary administration and pay plan maintenance.
  • Recommended changes or additions to all pay related policies and procedures.
  • Evaluation of total compensation to include pay and benefits and recommendations for balancing costs, while maintaining a competitive advantage over other cities and counties.

The resulting recommendations will be expected to address existing salary relationships between employees, offering recommendations as necessary regarding adjustments for pay equity. The successful proposal will provide a methodology for fair and equitable pay progression, benefits, and incentive rewards for employees. This recommended system needs to be market-responsive, equitable, and fair while valuing employee performance.

Background: The City of Derby is located just south of Wichita in Sedgwick County. It is a thriving community with a population of 25,625. The City has 237 full and part time positions across approximately 109 job classifications. These employees move through the pay grade, to which their job is assigned, based on annual performance reviews and associated merit increases conducted on their anniversary dates each year. The salary structure is organized by department and position with specified minimums and maximums.

The last market study completed by outside consultants was conducted in 2006. The methodology included gathering data from cities and counties throughout the state that were similar in size or who were in close proximity. A minimum of six comps were required for each position. The majority of the minimum and maximums were set at 85% and 115%, respectively, of the average for the position. The minimum and maximums for senior level positions were based on 80% and 120%, respectively, of the average for each position. Implementation included providing existing employees with 30% credit for their years of service. Between 2006 and 2019, pay studies were completed when difficulty was experienced in filling positions. Beginning in 2020, at the request of the City Employee Advisory Committee (CEAC), the HR division established a system for performing pay studies on 1/3 of all positions each year, to ensure that all positions were surveyed at least once every 3 years. The methodology for internal surveys has included using an established list of 11 cities and counties that are similar in size or in close proximity. The list of comparable entities used includes the following: Dodge City, Garden City, Gardener, Hays, Hutchinson, Leavenworth, Newton, Prairie Village, Salina, Wichita, and Sedgwick County. Job descriptions are compared against the surveyed positions to ensure that the job functions are similar. The formula used to provide employees credit for their years of service includes establishing the range of the position (subtracting minimum from the maximum), dividing that number by 14; multiplying this amount by the % of credit provided (30% for most, but 60% for hard to fill); multiplying this by the number of years of service and then adding it to the minimum. “Hard to fill” positions include Utilities Operators, Police Officers, Mechanics, and Civil Engineers.

A General Pay Adjustment (GPA) is typically provided only at the beginning of each year. However, in 2022, a 2% GPA was provided in January and then an additional 3% was provided in June. Additional pay increases are provided based on performance reviews, and are differentiated based on higher levels of performance. Merit pay ranges from 0% to 4%, with 1% for a “satisfactory” rating and 0.5% increases up to the maximum of 4%, for an exceptional rating.

Scope of Work: The City of Derby is soliciting proposals for Total Compensation Consulting Services with emphasis on classification and compensation. Primary components include evaluating benefits, assessing the pay plan and offering solutions to create market-competitive, equitable and effective plans, including provision of recommended policies and procedures to maintain sound salary administration and to support recruitment and retention efforts. This Scope of Work is intended to be a general guide to the work contemplated, and is not a complete list of all services that might be required or desired. The successful Candidate's response will include, at a minimum, responses on the following:

a) Provide a detailed description of the procedure and associated methodology that will be followed to develop a classification and compensation structure.

b) Recommend a classification and compensation plan establishing a competitive market position by providing compensation analysis using recommended sources, but must include data from comparative cities and counties, as well as potentially evaluating private sector data, where appropriate for hard-to-fill/critical positions. The Candidate will also recommend private sector organizations for ongoing inclusion regarding specified hard-to- fill/critical positions in Derby’s salary surveys. The following are minimum requirements:

  1. Conduct an analysis of the City’s pay ranges as compared to the external labor market, including comparable cities and counties and potentially comparable private employers, and make recommendations for changes to the pay ranges. This analysis must include job duties and responsibilities and not just titles. The City needs an estimated cost to use as a place holder for the budget no later than May 1, 2023.
  2. Ensure internal equity between positions occurs by reviewing job descriptions and ensuring that positions performing similar work with the same level of complexity, responsibility, knowledge, skills, and abilities are classified together.
  3. Assess and address any potential issues with internal equity for ongoing plan maintenance, including evaluating the current merit increase matrix.
  4. Compare performance and incentive pay practices with comparator cities, counties, and other market comparatives.
  5. Provide recommendations on all aspects of pay plan, including structure, whether to broadband, best practices for COLA/GPA, etc.

c) Conduct a total compensation analysis, including evaluation of the city’s contribution to health and dental insurance as well as other benefits compared against that provided by competitors. Evaluate entire package including benefits and compensation and make recommendation on changes to help ensure the city remains competitive for recruitment and retention.

d) Provide a proposed timeline to include the project initiation, all project milestones and completion dates for the study. Timeline should also include a clear outline of the communication plan for the project regarding milestones met, including the method of communication, frequency and target audience for communications. The study process should be transparent.

e) Share information learned from other studies and research of best practices for governmental entities and other comparable organizations.

f) Provide information collected through the Candidate’s previous project experience and a custom survey of market-comparable organizations in order to complete the following:

  1. Recommend comprehensive classification plan to support all full-time and part-time jobs.
  2. Recommend compensation plan which supports the classification plan and provides a competitive market position for the City of Derby.
  3. Recommend pay structure features that will provide opportunities for advancement, including consideration of career lattices/pathways when assessing and revising the job classification plan.
  4. Recommend policies on how to compensate for hard-to-fill/critical positions, such as police officers and utility workers, where competition is strong for talent.
  5. Recommend placement of current employees upon implementation within the appropriate classifications, including addressing any pay equity concerns that may arise, including differences in work hours.
  6. Recommend methods for rewarding higher skills/responsibilities or achievements without necessarily making employees a supervisor/manager.
  7. Recommend pay treatment for introductory employees and for “trainees” (new hires expected to meet minimum qualifications for a position within a specified timeframe).
  8. Recommend pay progression methods to include sound practices to prevent salary bypassing and mitigate pay compression. Implementation recommendations must address any pay equity issues discovered as part of this compensation analysis.
  9. Recommend best practices regarding flexible scheduling and the impact on compensation.
  10. Provide recommendation related to firefighter compensation to address the short-check and long-check issues related to leave scheduling.

g) The Candidate will develop written compensation philosophy and comprehensive salary administration guidelines for the Pay Plan to include strategies for the following:

  1. Ongoing pay structure maintenance (including recommended cycle for market review)
  2. Evaluation of all City pay policies and procedures to recommend any needed revisions/additions. Policies to be reviewed include, but are not limited to the following:
    1. Merit Increase and One Time Performance Pay
    2. Education Pay
    3. Bi-lingual Pay
    4. Standby and Callback Pay
    5. Interim and Acting Assignment Pay
    6. Acting Officer Pay
    7. Shift Differential
    8. Special Duty Pay
    9. Training Compensation
    10. Certification Pay
    11. Bonus and Recognition
    12. Referral Incentive
    13. Hiring Bonus for Police Officers.
  3. Evaluate and make recommendations related to position change policies, including Promotions, Reclassifications, Lateral and Non-Lateral Transfers, and Demotion.
  4. Evaluate and recommend hiring rate policies for external hires and for internal promotions. Provide salary offer guidelines to facilitate increased fairness in determining hiring rates based on a candidate’s qualifications.
  5. Provide guidelines for implementing future structure adjustments and how the adjustments should impact employee pay; these guidelines should be based on a methodology that allows the City to determine market-based salary adjustments consistent with maintaining a competitive position in the market, considering relative competing fiscal demands and financial constraints.
    1. Guidelines for merit-based salary increases (moving through assigned pay ranges)
    2. Pay policies with regard to promotions (percentages and timing of pay changes)
    3. Pay policies with regard to demotions and voluntary reassignments

h) The Candidate will also provide training and tools necessary for implementation; and recommend and/or provide any tools used in the study to allow the City to maintain the pay schedules in the future. The Candidate will give the City of Derby the database used to produce the recommendations, along with instruction of how to maintain the database.

i) The Candidate will recommend methods for awarding pay for performance using the proposed pay structures, including the review/reward schedule (currently anniversary date of hire or position change) as well as recommended percentage increases to remain competitive in the market. The recommendation will be expected to balance rewarding performance with equitable movement of personnel through the classification’s pay range.

RFP MANDATORY SUBMISSION REQUIREMENTS

This section is provided to assist participating candidates in forming a thorough response for services outlined in this document. Proposals submitted must reflect in detail their inclusion as well as the degree to which they can be provided. Responses to this RFP shall include the following information:

1) Cover Letter

• Describe firm size, longevity, structure, and type of clients served.

• Describe any memberships in relevant professional organizations.

• Firm experience in preparing total compensation studies for cities.

• Firm experience in performing demographic analysis and trend projections.

2) Project Approach/Written Proposal

• Describe the intended approach to accomplish the goals of the project.

• Demonstrate a clear understanding of the project and the steps necessary to provide a complete and useful total compensation study.

• Highlight any characteristics or capabilities that make the candidate uniquely qualified to perform the requested services.

• Any additional information believed necessary to assist the city in evaluating your proposal.

3) Proposed Fee Range

• Provide a proposed fee range for completing all work anticipated to be necessary to complete the project. The final scope and fee will be negotiated with the successful respondent but is expected to be consistent with the fee range submitted with this proposal. Fill out and include Appendix A- Cost Proposal Form in this section.

• Identify any additional services that the city may want to consider adding to the scope of the project and a fee range associated with the additional services.

4) Anticipated Project Schedule (including modifications, if requested)

5) Project Team (including a description of responsibilities) and Team Resumes

• Provide the name of the person who will be responsible for managing the project, and other significant staff anticipated to contribute including a comprehensive statement of each such person’s experience and qualifications.

• Highlight any characteristics or capabilities that make the candidate uniquely qualified to perform the services requested.

6) Work Samples (total of 3)

• Provide examples of at least three (3) similar projects completed for similarly sized communities in the last three (3) years. Examples may be provided in electronic format or by providing an internet link.

7) List of References (total of 3)

• Include the organization/business, address, contact person, phone number, date of services, and scope of services.

• Submit a statement disclosing any current, pending, or potential disciplinary action or complaint(s) or other like proceedings, including any claims in arbitration, mediation, or litigation, against the firm or against any partner or associate of the firm or team.

• Disclose any actual or potential conflicts of interest with the City, its officers, elected officials, agents and employees.

• Conform to the requirement to maintain strict confidentiality about all matters of this project.

• Describe any partnerships with any organizations/subcontractors/suppliers that will play a role in this project.

10) Certificate of Insurance

• Provide a copy of your certificate of insurance verifying professional, commercial general, automobile liability, and workers’ compensation insurance coverage with minimum policy limits as detailed in this RFP. The coverage must be maintained and carried in force for the duration of the contract.

Definitions in this RFP: City, RFP, Proposal, Candidate, Contractor, Should. Unless the context indicates otherwise – (a) The expressions “RFP,” “this RFP,” and “the RFP” refer to this document as it may be amended or updated. (b) “City” and “city” mean the City of Derby. (c) The “proposal” is the response of a person, firm, or corporation proposing to provide the services sought by this RFP. (d) The word “Candidate” or “candidate” is the person, firm, or corporation that submits a proposal or that is considering submitting a proposal. (e) The word “Contractor” or “contractor” is the person, firm, or corporation with which the City enters into a contract to provide the services sought by this RFP. That is, “contractor” generally refers to a successful candidate that has obtained a fully executed contract with the City, while “candidate” is generally reserved to the stage before a contract has been signed. (f) The word “should” is used to tell candidates what the City thinks it wants and/or what the project manager thinks is best. Candidates that want to increase the likelihood of being selected will, in general, do what the RFP says candidates “should” do, but failure to comply with all “shoulds” will not necessarily and automatically result in rejection.

Contract: The City anticipates that at the conclusion of the RFP process a written contract between the City and the successful candidate will be executed defining the roles and responsibilities of each party and under which the successful candidate will provide the goods and services generally described in this RFP.

Schedule: The City intends to finalize its recommendation of a vendor no later than January 4, 2023 with a Council Award date of January 10, 2023. Below is a tentative timeline that reflects our anticipated dates for certain milestones related to the selection process.

SELECTION CRITERIA

Derby will thoroughly review all proposals received and may conduct an interview process for top proposals and to further discuss services and pricing. Interviews of selected consultants will be conducted by representatives of the City and the committee’s recommendation will be forwarded to the City Council for final action. A candidate’s initial offer should therefore be based on the most favorable terms available from a price and technical standpoint. Derby reserves the right to conduct discussion or negotiation with any candidate regarding any proposal Derby deems competitive. Derby may also request best and final offers from any candidates and make an award or conduct negotiations thereafter. Derby reserves the right to select and recommend for award the proposal which best meets, in its sole discretion, its required needs, budget constraints, quality levels, and administrative expectations. Due to the importance of this project, Derby also reserves the right to select one or more firms to accomplish this task or to reject all proposals.

Representatives of Derby will evaluate each proposal based, but not limited to, the following criteria:

  1. Demonstrates clearly and completely, your firm’s ability to meet all RFP conditions and miscellaneous instructions as outlined herein;
  2. Demonstrates the skill and experience necessary to meet Derby’s needs (provide professional resumes for all personnel to be involved in the study and a clear indication of the responsibilities of each project team member);
  3. Meets mandatory requirements outlined herein;
  4. Proposes services described herein with the most advantageous and prudent methodology and cost to Derby. Must complete attached Appendix A to show the cost breakdown;
  5. Provides references reflecting projects having a scope of services similar to those requested by Derby within the last three (3) years (include location, contact person, telephone number, length of contract, and any other pertinent information related to this type of project); and
  6. Provides a certificate of insurance by the successful candidate evidencing insurance coverage for all work and services to be performed as part of the contract award in amounts not less than the following:

The above amounts are the minimum insurance requirements necessary to comply with the submission requirements for this RFP and the commercial general liability limits may be achieved through the use of an umbrella or excess coverage policy. Said certificate of insurance shall be written by a reputable insurance carrier approved by Derby and the final certificate will name Derby as an additional insured on general liability and automobile liability coverages. In addition, insurance policies applicable hereto shall contain a provision that provides the City shall be given thirty (30) days’ written notice by the insurance company before such policy is substantially changed or canceled.

NO NEGOTIATIONS, DECISIONS OR ACTIONS SHALL BE INITIATED BY ANY FIRM OR CANDIDATE AS A RESULT OF ANY VERBAL DISCUSSION WITH ANYONE, INCLUDING CITY EMPLOYEES, PRIOR TO COMPLETION OF THE RFP PROCESS.

CONFIDENTIAL MATTERS

Anyone submitting a proposal agrees that all data, records and information which candidate, its agents and employees obtain access to, create, and which are the subject of this proposal, remain at all times exclusively the property of Derby. Anyone submitting a proposal also agrees that all such data, records and information constitute, at all times, proprietary information of the City and that candidate will not disclose, provide or make available any such proprietary information in any form to any person or entity. In addition, anyone submitting a proposal agrees that it will not use any names or addresses contained in such data, records, and information for the purpose of selling or offering for sale any property or service to any person or entity who resides at any such address in such data; that it will not sell, give or otherwise make available to any person or entity any names or addresses contained in or derived from such data, records or information for the purpose of allowing such person to sell or offer for sale any property or service to any person or entity named in such data.

Anyone submitting a proposal further agrees that it will take reasonable steps and the same protective precautions to protect Derby’s proprietary information from disclosure to third parties as with the candidate’s own proprietary and confidential information and that all data, regardless of form, that is generated as a result of this RFP is the property of Derby.

Information provided in your response will be considered proprietary and will not be divulged during the proposal review process unless otherwise required by law. Because the services sought will require the expenditure of public funds, part or all of the successful proposal, as well as a resulting contract, will likely be public records within the meaning of the Kansas Open Records Act. Prior to acceptance of a proposal the information contained in each proposal will be used for evaluating the candidate’s ability to handle the scope of services and will not be shared with persons not involved in the evaluation of proposals unless otherwise required by law.

PROPOSAL CONDITIONS

In submitting a response to this RFP, candidate hereby understands and acknowledges the following:

  1. Responses must be received by the City prior to the deadline date and time to be considered.
  1. Derby reserves the right to:
    1. Cancel the RFP process or the work described herein prior to issuance and acceptance of any final agreement even if the Derby City Council has formally accepted a recommendation and authorized execution of an agreement;
    2. Accept or reject any and all responses;
    3. Request additional information or clarification from those submitting responses and allow corrections to errors and omissions. Clarifications to a candidate’s response shall be signed by an officer of the candidate authorized to commit the candidate to all terms and conditions contained in the response;
    4. Disregard responses that do not meet the stated requirements as determined by the City. Responses which are non-responsive, conditional or not in compliance with the information requested in this RFP will be disqualified unless the City waives such non-compliance;
    5. Waive any technicalities or irregularities involving any response, including noncompliance;
    6. Select the candidate that will best meet the needs of the City; and
    7. Negotiate with the candidate submitting the best response to obtain an eventual agreement to provide the requested services.
  1. The City will not pay for any information requested herein, nor is it liable for any costs incurred by those submitting proposals.
  2. All responses and related information submitted in response to the RFP will become the property of the City and will not be returned. Each candidate submitting a response waives any right of confidentiality to the proposal documents. If a candidate submitting a proposal considers certain material in the response to be proprietary information, it should clearly designate those portions of the response it wishes to remain confidential. As a public entity, the City is subject to making records available for public disclosure as required by law. The City will make reasonable attempts to maintain the confidentiality of material marked proprietary; however, it cannot guarantee information will not be made public.
  3. By submission of a response, each candidate certifies that:
    1. The candidate has not paid nor agreed to pay any person, other than a bona fide employee or subcontractor, a fee or a brokerage commission resulting from award of the contract.
    2. The City may, by written notice, cancel any award under this RFP if it is found by the City that gratuities in the form of entertainment, gifts or otherwise were offered or given to any representative of the City with a view toward securing the award of a contract or other favorable treatment with respect to this RFP.
  4. Derby reserves the right to make any agreements subject to the provisions of the Kansas Cash Basis Law (K.S.A. 10-1112 and 10-1113) and the Kansas Budget Law (K.S.A. 79-2935). Agreements shall be construed and interpreted so as to ensure that the City shall at all times stay in conformity with such laws, and as a condition of agreements, the City reserves the right to unilaterally sever, modify, or terminate agreements at any time, if in the opinion of its legal counsel the Agreement may be deemed to violate the terms of such law(s).
  5. All project participants, consultants, and contractors must comply with applicable Federal, State, County, and local municipal laws pertaining to contracts entered into by governmental agencies, including non- discrimination in employment, the provisions of the Kansas Act Against Discrimination (K.S.A. 44-1001 et seq.), the provisions of K.S.A. 44-1030, and the following terms:
    1. The successful candidate will observe the provisions of the Kansas Act Against Discrimination and shall not discriminate against any person in the performance of work under this project because of race, religion, color, sex, disability, national origin, or ancestry;
    2. In all solicitations or advertisements for employees, the successful candidate shall include the phrase “Equal Opportunity Employer,” or a similar phrase to be approved by the Kansas Human Rights Commission;
    3. If the candidate fails to comply with the manner in which it reports to the Kansas Human Rights Commission in accordance with state law, the candidate will be deemed to have breached its contract with the City and the contract may be canceled, terminated, or suspended, in whole or in part, by the City.
    4. If the candidate is found guilty of a violation of the Kansas Act Against Discrimination under a decision or order of the Kansas Human Rights Commission which has become final, the candidate will be deemed to have breached its contract with the City and the contract may be canceled, terminated, or suspended, in whole or in part, by the City; and
    5. The successful candidate will include the provisions of the above subsections (a) through (d), inclusive, of this paragraph in every subcontract or purchase order so that such provision will be binding upon such subcontractor or contractor.
  6. Alternate proposals (two or more proposals submitted) will be considered for an award. The City reserves the right to make the final determination of actual equivalency or suitability of such proposals with respect to requirements outlined herein.
  7. The City may award a contract based on initial offers received without discussion of such offers. A vendor’s initial offer should therefore be based on the most favorable terms available from a price and technical standpoint. The City may however have discussion with those vendors that it deems, in its discretion, to fall within a competitive range. The City may also request best and final offers from such candidates and make an award and/or conduct negotiations thereafter.
  8. Prices proposed may not be withdrawn for a period of 120 days immediately following the opening of proposals. Prices MUST be free of federal, state, and local taxes unless otherwise imposed by a governmental body.
  9. The City interprets “lowest responsible candidate” as requiring the City to (a) choose between the kinds of services subject to the proposal, and (b) determine which proposal is most suitable for its intended use or purpose and maintenance costs of items upon which proposals are received. The City can determine any differences or variations in the quality or character of the services performed or provided by the respective candidates.
  10. All requested information must be supplied. If you cannot respond to any part of this request, state the reason you cannot respond. You may provide supplemental information, if necessary, to assist the City in analyzing your proposal.
  11. After the award, if the successful candidate refuses or fails to provide the services within the times specified in the RFP proposal or contractual agreement, the City may, by written notice, terminate the award and contract.
